ShopWerks is owned and operated by Amphibious Powersports (“ShopWerks,” “Amphibious Powersports,” “we,” “us,” or “our”).

This Privacy Policy explains how we collect, use, disclose, store, and protect information when you use shopwerks.net, ShopWerks software and services, ShopWerks-powered websites and integrations, our browser extension, and other services that link to this Privacy Policy (collectively, the “Services”).

ShopWerks is intended primarily for businesses and adult users located in the United States.

By accessing or using the Services, you acknowledge the practices described in this Privacy Policy.

1. Information We Collect

The information we collect depends on how you interact with ShopWerks and which features you use.

Account and Business Information

When you register for or use ShopWerks, we may collect information such as:

  • Name
  • Email address
  • Telephone number
  • Business or shop name
  • Billing or mailing address
  • Username and account identifiers
  • Password credentials stored in protected or hashed form
  • Account preferences and settings
  • Subscription or account status

Customer and Client Information Entered Into ShopWerks

ShopWerks is designed for use by businesses, including automotive, powersports, repair, service, sales, and related businesses.

Business users may enter information concerning their own customers or clients into ShopWerks or into ShopWerks-powered websites. Depending on how a business uses the Services, this information may include names, contact information, addresses, notes, invoices, estimates, repair orders, communications, transaction information, and other information supplied by the business.

This information is generally provided and controlled by the ShopWerks business customer that entered it.

ShopWerks does not independently collect this information for the purpose of creating consumer profiles, advertising to those consumers, or selling information about those consumers.

Our personnel generally do not review customer information entered into a ShopWerks business account except when access is reasonably necessary to:

  • Provide support requested by the ShopWerks customer;
  • Troubleshoot technical problems;
  • Maintain or secure the Services;
  • Investigate suspected fraud, misuse, or security incidents;
  • Restore or maintain data;
  • Comply with legal obligations; or
  • Protect the rights, property, or security of ShopWerks, our customers, or others.

Business customers using ShopWerks are responsible for ensuring that their own collection and use of customer information complies with applicable law.

Vehicle and Service Information

ShopWerks may process information concerning vehicles and equipment serviced, sold, quoted, inventoried, or otherwise entered into the Services.

This may include:

  • Vehicle Identification Numbers (VINs)
  • Serial numbers
  • Year
  • Make
  • Model
  • Trim or configuration
  • Mileage or hours
  • Vehicle condition
  • Parts installed or removed
  • Repair information
  • Service history
  • Maintenance history
  • Diagnostic information
  • Estimates
  • Work performed
  • Parts and labor information
  • Technician notes
  • Related service records

ShopWerks may maintain vehicle service history in order to provide the features of the Services.

ShopWerks does not independently attempt to create databases identifying the individual owner of a particular vehicle unless that information has been entered into the Services by a business customer and is necessary to provide the requested ShopWerks functionality.

Orders and Payment Information

When purchases or payments are made through ShopWerks, we may collect information concerning the transaction, including:

  • Products or services purchased
  • Order amount
  • Billing information
  • Shipping information
  • Transaction date
  • Payment status
  • Order number
  • Payment processor transaction identifiers

ShopWerks uses WooCommerce and PayPal in connection with certain transactions.

Payment card information may be collected and processed directly by the applicable payment provider. ShopWerks does not intentionally store complete credit or debit card numbers when those numbers are processed by a third-party payment processor such as PayPal.

Payment providers maintain their own privacy and security practices, and information submitted directly to those providers is also subject to their applicable policies.

Communications

When you communicate with us or use communication features provided through ShopWerks, we may process information such as:

  • Email addresses
  • Telephone numbers
  • Email messages
  • Text messages
  • Support requests
  • Message content
  • Delivery information
  • Communication history

ShopWerks operates its own email and telephone/messaging infrastructure for many of these functions. Internet, telephone, telecommunications, and network carriers may necessarily process communications in order to transmit them.

Uploaded Content

If a ShopWerks feature permits uploads, we may process files or content that users choose to upload, including:

  • Images
  • Documents
  • Attachments
  • Receipts
  • Vehicle-related records
  • Business records
  • Other files supplied through the Services

We use this information to provide the functionality for which it was submitted.

Technical and Usage Information

When you access ShopWerks, our systems may automatically receive limited technical information such as:

  • IP address
  • Browser type
  • Device type
  • Operating system
  • Date and time of access
  • Pages or ShopWerks features accessed
  • Login activity
  • Error information
  • Security events
  • Referring pages
  • Session identifiers

We use this information primarily to operate, secure, troubleshoot, maintain, and improve the Services.

2. Cookies and Similar Technologies

ShopWerks uses cookies and similar technologies where necessary to operate the Services.

These may include cookies used for:

  • User authentication;
  • Maintaining logged-in sessions;
  • Account security;
  • Saving user preferences;
  • Preventing fraud or abuse;
  • Maintaining application functionality; and
  • Diagnosing technical problems.

ShopWerks may also use Google Analytics or similar analytics technology on shopwerks.net to help us understand website traffic, performance, and general usage.

We do not use cookies for the purpose of selling personal information.

Browser settings generally allow you to block or remove cookies. Disabling cookies necessary for authentication or application functionality may prevent portions of ShopWerks from operating correctly.

3. How We Use Information

We may use information collected through ShopWerks to:

  • Create and maintain user accounts;
  • Authenticate users;
  • Operate the ShopWerks platform;
  • Provide repair, service, estimating, invoicing, customer-management, inventory, parts, vehicle-history, and related functionality;
  • Process purchases and subscriptions;
  • Maintain vehicle service records;
  • Provide customer support;
  • Respond to inquiries;
  • Send account, service, or transactional communications;
  • Provide email or text-messaging functionality requested by users;
  • Diagnose technical problems;
  • Improve ShopWerks functionality;
  • Maintain system reliability;
  • Detect and prevent fraud or abuse;
  • Protect accounts and systems;
  • Enforce our agreements;
  • Maintain records required for legitimate business purposes;
  • Comply with legal requirements; and
  • Protect the rights and safety of ShopWerks, our users, and others.

We do not use information entered into ShopWerks by a business customer to independently market unrelated products to that business’s customers.

4. ShopWerks Browser Extension

ShopWerks provides a browser extension that works with ShopWerks OEM parts functionality.

Extension Purpose

The ShopWerks browser extension has a limited purpose: to obtain eBay OEM-parts market information for the ShopWerks OEM Used Parts system by searching OEM part numbers and reading relevant active and sold/completed eBay search results.

The extension is not designed to monitor a user’s general browsing activity.

Information Handled by the Extension

When a user uses the applicable ShopWerks market-research functionality, the extension may receive an OEM part number from the ShopWerks WordPress page or ShopWerks-powered site that the user has connected.

On eBay search-result pages, the extension may read information displayed in relevant listing cards, including:

  • Listing titles
  • Displayed prices
  • Item links
  • Listing subtitles
  • Active-listing information
  • Sold or completed-listing information
  • Visible item or result-card text necessary to identify exact OEM part-number matches

The extension uses this information to provide relevant OEM-parts market evidence to the connected ShopWerks system.

Results obtained by the extension are returned only to the ShopWerks or WordPress origin that the user has explicitly connected for this functionality.

Information the Extension Does Not Collect

The ShopWerks browser extension does not collect or transmit:

  • General web browsing history;
  • eBay passwords;
  • eBay authentication credentials;
  • eBay cookie values;
  • Passwords from unrelated websites;
  • Advertising profiles;
  • Behavioral advertising information;
  • User profiling information; or
  • Browsing activity unrelated to the ShopWerks feature being used.

The extension does not use browsing information for advertising.

Extension Local Storage

The extension may use browser extension storage to retain limited operational information such as:

  • The identifier for a reusable eBay worker tab; and
  • ShopWerks or WordPress origins that the user has explicitly connected.

This information is used solely to operate the extension and maintain the user’s connection settings.

Browser Permissions

The extension may request browser permissions necessary to perform its disclosed functionality.

These permissions may include:

Storage — used to retain operational settings such as the connected ShopWerks/WordPress origins and reusable eBay worker-tab information.

Scripting — used to inject the ShopWerks communication bridge into an approved and connected WordPress administrative page.

Active Tab — used when the user explicitly connects, selects, or adopts the current ShopWerks/WordPress or eBay tab for the extension’s functionality.

Host access to eBay — used to access applicable eBay pages for OEM-part market searches and to read relevant rendered search-result information.

Optional website host access — may be requested when necessary to connect the extension to a customer-controlled ShopWerks or WordPress installation. This access is used for the ShopWerks integration selected by the user and not for general browsing surveillance.

No Remote Extension Code

The ShopWerks browser extension does not download or execute remote program code as part of its extension logic. Extension functionality is included within the distributed extension package.

Human Access to Extension Data

ShopWerks personnel do not routinely review information processed through the browser extension.

Human access may occur when:

  • A user specifically requests technical support requiring access to the relevant information;
  • Access is necessary to investigate security, fraud, or abuse;
  • Access is required to maintain or troubleshoot the Services; or
  • Access is required by law.

Chrome Web Store Limited Use

ShopWerks’s collection and use of data through its browser extension is limited to providing and supporting the extension’s disclosed functionality.

ShopWerks does not sell extension user data or transfer extension user data for personalized advertising, creditworthiness determinations, data-broker activities, or unrelated purposes.

ShopWerks’s use of information obtained through the browser extension will comply with the Chrome Web Store User Data Policy, including its Limited Use requirements.

5. How We Disclose Information

ShopWerks does not sell personal information.

We also do not disclose personal information to third parties for their own behavioral advertising or data-broker purposes.

We may disclose information in the following limited circumstances.

Service and Transaction Providers

Information may be provided to companies or systems necessary to complete a service requested by the user.

For example, payment and order information may be processed using WooCommerce-related functionality and PayPal.

We limit these disclosures to information reasonably necessary for the applicable service.

Telecommunications and Infrastructure Providers

Internet, domain, network, telephone, email-delivery, telecommunications, and similar infrastructure providers may necessarily process limited technical or communication information in order to transmit data or provide connectivity.

Analytics

If Google Analytics or a similar analytics service is enabled, limited website usage and device information may be processed by that analytics provider for website measurement and performance purposes.

We do not provide ShopWerks business customer records or vehicle service histories to analytics providers for advertising purposes.

Legal Requirements

We may preserve, access, or disclose information where we reasonably believe doing so is necessary to:

  • Comply with a court order, subpoena, legal process, or applicable law;
  • Respond to a lawful government request;
  • Protect our legal rights;
  • Investigate fraud or illegal activity;
  • Protect the safety of users or others; or
  • Investigate or respond to security incidents.

Business Transactions

If ShopWerks or Amphibious Powersports is involved in a merger, acquisition, financing, reorganization, bankruptcy, sale of assets, or similar business transaction, information may be transferred as part of that transaction subject to applicable law.

6. We Do Not Sell Personal Information

ShopWerks does not sell personal information for money or other consideration.

ShopWerks does not operate as a data broker.

We do not sell:

  • Account information;
  • Customer information entered by ShopWerks businesses;
  • Vehicle information;
  • Service history;
  • Browser-extension information;
  • Communications; or
  • Usage information.

We also do not share personal information for cross-context behavioral advertising as that term is used under California privacy law.

7. Business Customer Data

When a business uses ShopWerks to maintain records concerning its own customers, that business remains responsible for its relationship with those customers and for determining the lawful purposes for which the information is collected and used.

ShopWerks processes such information primarily to provide software functionality and services requested by the ShopWerks business customer.

ShopWerks does not claim ownership of a business customer’s underlying customer records merely because those records are entered into or processed using ShopWerks.

ShopWerks may retain technical records, vehicle service-history information, transaction records, system records, backups, and other information where reasonably necessary to provide the Services, maintain data integrity, comply with legal obligations, resolve disputes, enforce agreements, or protect the security of our systems.

8. Data Retention

We retain information only for as long as reasonably necessary for the purposes for which it was collected or for legitimate operational, legal, security, accounting, or business purposes.

The appropriate retention period may depend on factors such as:

  • Whether an account remains active;
  • Whether information forms part of a vehicle’s service history;
  • Contractual obligations;
  • Tax and accounting requirements;
  • Fraud-prevention requirements;
  • Security needs;
  • Backup and disaster-recovery practices;
  • Pending disputes or litigation; and
  • Applicable law.

When information is no longer reasonably required, we may delete, anonymize, or securely dispose of it.

Deletion from active systems may not immediately remove information from backups or disaster-recovery systems. Backup copies may remain until they are overwritten or expire through our normal backup-retention processes.

9. Account and Data Deletion Requests

Users may request deletion of their ShopWerks account or personal information by contacting:

We will evaluate and process valid deletion requests as required by applicable law.

Certain information may be retained despite a deletion request when reasonably necessary to:

  • Complete transactions;
  • Maintain legally required business records;
  • Comply with tax or accounting obligations;
  • Detect or prevent fraud;
  • Maintain security records;
  • Protect legal rights;
  • Resolve disputes;
  • Enforce agreements;
  • Maintain necessary backup systems; or
  • Comply with other legal obligations.

If information was entered into ShopWerks by an independent ShopWerks business customer, a person seeking deletion of that business’s customer records may need to contact that business directly because the business controls those records.

10. Data Security

We use reasonable administrative, technical, and organizational safeguards designed to protect information against unauthorized access, destruction, loss, alteration, or disclosure.

Security measures may include access controls, authentication, network protections, system monitoring, backups, encrypted connections, restricted administrative access, software updates, and other measures appropriate to the systems involved.

No computer system, network, database, or internet transmission can be guaranteed to be completely secure. Accordingly, we cannot guarantee absolute security.

Users are responsible for maintaining the confidentiality of their own account credentials and should notify us promptly if they believe their account has been accessed without authorization.

11. Children’s Privacy

ShopWerks is a business-oriented service intended for use by adults.

The Services are not directed to children under 13, and we do not knowingly collect personal information directly from children under 13.

If we learn that personal information from a child under 13 has been collected directly by us without appropriate authorization, we will take reasonable steps to delete it.

Nothing about ShopWerks is intended to provide adult entertainment or adult content; the adult-user limitation reflects the business and commercial nature of the Services.

12. United States Service

ShopWerks is intended primarily for users and businesses located in the United States.

We do not represent that ShopWerks is designed to satisfy privacy requirements applicable to businesses established in other countries or jurisdictions.

13. California Privacy Notice

This section provides additional information for California residents.

To the extent that the California Consumer Privacy Act, as amended by the California Privacy Rights Act (“CCPA”), applies to ShopWerks or a particular processing activity, California residents may have rights concerning their personal information.

Categories of Personal Information

Depending on use of the Services, ShopWerks may collect or process categories of information including:

  • Identifiers, such as names, usernames, email addresses, telephone numbers, IP addresses, account identifiers, and similar information;
  • Customer-record information, such as addresses, telephone numbers, billing details, or other information entered into ShopWerks;
  • Commercial information, such as orders, purchases, estimates, invoices, subscriptions, service records, and transaction history;
  • Internet or electronic activity information, such as device information, browser information, login history, session information, and interactions with the Services;
  • Vehicle and equipment information, such as VINs, serial numbers, vehicle characteristics, service history, repairs, and maintenance records;
  • Communications, such as support requests, emails, text messages, and other communications; and
  • Account authentication information, where necessary to secure ShopWerks accounts.

We collect these categories from users, ShopWerks business customers, devices used to access the Services, transactions, and systems involved in providing ShopWerks functionality.

We use this information for the purposes described throughout this Privacy Policy.

California Rights

Where applicable, a California resident may have the right to request that we:

  • Confirm whether we process their personal information;
  • Provide access to certain personal information;
  • Provide information concerning categories of information collected;
  • Correct inaccurate personal information;
  • Delete certain personal information;
  • Provide certain information in a portable format; and
  • Provide information about applicable disclosures of personal information.

California law also provides certain rights concerning the sale or sharing of personal information.

ShopWerks does not sell personal information and does not share personal information for cross-context behavioral advertising.

Because ShopWerks does not engage in those activities, we do not maintain a program for selling personal information to which a consumer must opt out.

Exercising California Rights

We may need to verify the identity and authority of the person submitting a request before fulfilling it.

An authorized agent may submit a request where permitted by law. We may request documentation establishing the agent’s authority and may separately verify the identity of the consumer.

We will not unlawfully discriminate against a person for exercising an applicable privacy right.

Global Privacy Control and Do Not Track

ShopWerks does not sell personal information or share it for cross-context behavioral advertising.

Because there is currently no universally accepted standard governing all browser “Do Not Track” signals, our websites may not respond to traditional Do Not Track signals.

Where a legally recognized browser-based opt-out preference signal applies to a business that sells or shares personal information, applicable law may require recognition of that signal. ShopWerks does not currently engage in the sale or sharing of personal information for which such an opt-out is required.

14. Third-Party Websites and Services

ShopWerks may contain links to or integrations with third-party websites and services.

Examples include PayPal, eBay, Google Analytics, or other services a user chooses to interact with.

A third party’s handling of information on its own systems is governed by that third party’s privacy practices and terms.

ShopWerks is not responsible for the independent privacy practices of third-party websites or services.

15. eBay Information Used by ShopWerks

Certain ShopWerks features may retrieve or analyze publicly displayed eBay listing information to assist users with OEM-parts market research.

This functionality is intended to identify relevant active and sold/completed listings associated with an OEM part number.

ShopWerks does not use this functionality to obtain eBay account passwords, authentication cookies, or unrelated private account information.

Information obtained through this functionality is used to provide the market-research feature requested by the ShopWerks user.

16. Support Access

ShopWerks support personnel may occasionally require access to an account, installation, record, log, or other information in order to diagnose or resolve a support request.

We limit such access to circumstances where it is reasonably necessary to provide support, maintain system security, troubleshoot a problem, or perform another legitimate operational function.

Users should avoid sending unnecessary sensitive personal information through support communications.

17. Changes to This Privacy Policy

We may update this Privacy Policy when ShopWerks features, legal requirements, security practices, or data-handling practices change.

The updated policy will be posted on shopwerks.net with a revised “Last Updated” date.

If we make a material change to the way information is collected, used, or disclosed, we may provide additional notice where appropriate or required by law.

For the ShopWerks browser extension, if a change materially alters the extension’s collection or use of user data, we will provide appropriate disclosure and obtain consent where required before applying the new data practice.
